Albania Prepare to Host the High Level Energy Meeting 2015 by Dr Lorenc Gordani | Saturday, August 15, 2015

On 16 October 2015, due to actual role of holder of the
Energy Community Presidency for the 2015, the 13th Ministerial Council Meeting will be take place in
Tirana, Albania. The here ministerial follow the summit to be held in Vienna
this August, seeing as a crucial, a fully alignment with EU energy legislation
(namely EU Third Energy Package) and bring back healthy competition against
corruptive practices, in order to encourage foreign private investment in power
generation, cross-border interconnectors, and more significant use of renewable
energy and efficiency measure.

Indeed
the Ministerial Council (MC) is the highest
decision making body of the Energy Community and it convenes with regularity once
a year. The key task of the Ministerial
Council is to ensure that the objectives set out in the Treaty establishing the
Energy Community are attained. According to the Treaty, the ministers: provide
general policy guidelines; take Measures; and adopt Procedural Acts.

In concrete terms, the ministers can, inter alia, decide to extend the acquis,
adapt the existing acquis or establish a new institution or working group. It
is also the Ministerial Council that decides on the accession to the Energy
Community, be it for Observer or Contracting Party status. The Council also
approves the Secretariat’s budget and work programme. The Treaty also defines the
reporting obligations of the Ministerial Council. In more, once a year, the
Ministerial Council submits a report on the activities of the EnC to the EP and
to the Parliaments of the CP and the Participants.

In following of the deep reform overtake by
the EnC and in the central role that the WBs have in the new strategy of the
Union of Energy this year see the address of an opening speech by Commissioner
Miguel Arias Cañete. Presentation that it will proceed with the session on Energy
Community for the Future seeing the deliver of the General Policy Guideline
“Roadmap on Reform of Energy Community”. In following it will proceed
with Decision D/2015/01/MC-EnC on the implementation of the Energy Efficiency
Directive (2012/27/EU), Decision D/2015/02/MC-EnC on the implementation of
Regulation 347/2013, and General Policy Guideline “Future Joint Act on
Security of Supply”.

As usual the annual meeting see the delivery
of report about the implementation of the Treaty. This year one of the dispute
settlement report focus the Decision on Sanctions on Bosnia and Herzegovina
under Art. 92.1 of the Treaty. In the regard of regional market integration
initiatives, the work will focus also to the WBs 6 Summit on the Market
Coupling project of Ukraine and Moldova CESEC. The activity is also the occasion
of the appointment of the Director of the Energy Community Secretariat Mr Janez
Kopač.

And in last the Ministerial Conclusions: with
the Handover of the Albanian Presidency, the Annual Report on the Activities of
the Energy Community (ECS). Decision on the implementation of Commission
Regulation (EU) No 431/2014 of 24 April 2014 amending Regulation (EC) No
1099/2008 of the European Parliament and of the Council on energy statistics,
as regards the implementation of annual statistics on energy consumption in
households.

Other work that are attening for an adoption such is the Decision on the failure
of the Republic of Albania to comply with the Energy Community Treaty in Case
ECS-3/14, on the failure of the Bosnia and Herzegovina to comply with the
Energy Community Treaty in Case ECS-4/14, and on the failure of the Former
Yugoslav Republic of Macedonia to comply with the Energy. Decision on setting
an implementation deadline for existing plants with regard to Chapter III and
part I of Annex V of Directive 2010/75/EU on industrial emissions. Decision on
amending Decision D/2013/05/MC-EnC of 24 October 2013 on the implementation of
Directive 2001/80/EC.

In last but not least the appointment of the
Members of the Advisory Committee 2016-2017. The Procedural Act on amending
Annex 26, for adoption of the Procedural Act on strengthening the role of civil
society. The adoption of the Procedural Act on the Rules of Procedure for
Dispute Settlement under the Treaty and the establishment of an Energy
Community Parliamentary Plenum meetings.
