Focus on Liability on the Environmental Matter in Albania by Dr Lorenc Gordani, 02 December 2015

According to the last investment guide published recently
by AIDA on the matter of Environmental law, Albania applies the Law on the
Protection of Environment in line with Directive 2004/35/CE of the European
Parliament and of the Council of 21 April 2004.

This law sets out the principles, requirements,
responsibilities, duties and general procedures for ensuring a high-level
protection of the environment in Albania. The Law on the Protection of
Environment, in line with EU Directive on environmental liability with regard
to the prevention and remedying of environmental damage set out Environmental
permits.

Environmental permits are divided into three
categories depending on the activity:

For activities of category A, type A;

For activities of category B, type B;

For activities of category C, type C.

The environmental permits are issued by the
National License Center (NLC), prior approval of the National Environmental
Agency and Minister of the Environment and of the Regional Environment Agency.
