Independence of Moldovan energy regulator threatened again, 12 Aug 2015

The ECS is concerned about the attempts to influence the energy regulator of Moldova, ANRE, in its decision-making. Independence of the regulator from political influence ranks among the most important principles of the Energy Community. In the past, the regulator’s independence has already been seriously impaired by the removal of ANRE’s former Director General from office. Recent events indicate that the alarming practice of influencing the regulator’s decision-making continues in Moldova. By a letter to Deputy Prime Minister and Minister of Economy, Stephane Bridé, the Secretariat had already raised its concerns as regards the delay in adoption by the Parliament of ANRE’s 2015 budget and a tariff review carried out by the Court of Auditors.

Most recently, the country’s Supreme Security Council invited ANRE to suspend its decisions of 18 July 2015 related to an increase of natural gas and electricity prices. The increase in electricity prices in particular had become necessary in order to ensure cost-reflectivity of electricity prices in view of the depreciation of the Moldovan currency. Non cost-reflective electricity prices pose a serious risk to the country’s energy security. The social impact of this decision must be addressed in a manner not threatening security of supply.

Given Moldova’s commitments under the Energy Community Treaty, any attempt to influence the regulator’s decision-making cannot be accepted. The Secretariat will observe closely ANRE’s reaction to the Supreme Security Council recommendation, and if necessary take further action.
