Energy Community regulators to participate in EU’s Agency for the Cooperation of Energy Regulators
31 Mar 2015

Following an initiative by the Secretariat, the European Commission and the Agency for Cooperation of Energy Regulators (ACER) have clarified the conditions for the participation of Contracting Parties’ national regulatory agencies as observers in the Board of Regulators of ACER. This will yield a better and more efficiently linked institutional set-up within the internal energy market governed by the Third Energy Package.

Under the legal provisions establishing ACER, non-EU regulators’ participation in ACER is conditional on full implementation of the Third Package under an agreement with the EU. The Commission’s clarification will make these provisions operational in practice. It envisages an assessment of effective implementation of the Third Package to be conducted by the European Commission with an involvement of the Energy Community Secretariat. Participation in ACER’s Working Groups may be possible even at an earlier stage.
