Yesterday, the Energy Community Secretariat has given an opinion on the extra-territorial application of Energy Community competition law in cases involving operators from third countries. This opinion was requested by the Antimonopoly Committee of Ukraine (AMCU) under the new Article 2 of the Dispute Settlement Rules.
This provision was introduced to facilitate the cooperation between national authorities and the Secretariat on questions concerning the interpretation or application of Energy Community law.
